This website is powered by Double Take Microwear (The Company). This agreement is between you, The Member, and The Company. Every time you access this service you confirm your agreement with the Terms of Service. The Terms of Service are personal to you and may not be assigned or transferred to anyone else.

The Company reserves the right to exercise editorial control over profile content, pictures and any other content on this website. You may not create more than one profile. If the Member's profile is removed for any reason, including violating these Terms of Service, the Member may not create another profile on this website.

The Company does not verify the accuracy or truth of any information published by Members. You may not publish offensive content directed at other members. The Company, in its sole discretion, will determine if content is deemed offensive. You may not publish content that encourages behavior that may constitute a criminal offense, result in civil liability or otherwise violate your applicable local, state, national or international laws or regulations. You may not publish content (including photographs) that directly or indirectly alludes to child pornography or attempts to solicit communication with or on behalf of any person under the age of 18.

While The Company reserves the right to edit or remove content deemed offensive and/or inappropriate, The Company does not guarantee that such material will be removed or deleted. Failure by The Company to remove such content does not waive our right to remove or delete offensive content in subsequent or similar cases. Commercial messages are not allowed in Member profiles. The Company reserves the right to excerpt photographs and text quotes from profiles, along with the Member screen name, and feature them in promotional material, including, but not limited to, the featured members lists. Should the Company wish to use your profile, including photographs, for promotional purposes other than featured members, The Company will contact the Member via email to request permission.

3. Login Details
You as a Member are solely responsible for maintaining the confidentiality of your Member name and password.

4. Copyrighted Material
You may not post copyrighted material on the site. This includes but is not limited to photographs, images and text. Should you believe that copyrighted material has been posted on the site you are requested to contact The Company with full details of the alleged copyright infringement including the Member username and your contact details.

5. Harassment and Disputes
Harassment of other members is strictly prohibited.

6. Content Visibility
Member profiles and Member pictures from this site may also be visible (where applicable) on other network sites operated by The Company or its affiliates.

7. Fees and Cancellation
The Company's usage and/or subscription policies may change at any time without notice. The Company reserves the right to terminate your access to the site for any reason or no reason. The Member may cancel their Membership and/or subscription at any time for any reason or no reason. If subscription fees were charged, refunds will be given at the discretion of the Company management and are under no circumstance transferable from one Member profile to another. If The Company terminates your membership because you have breached this Agreement, you will not be entitled to any refund or any unused subscription fees. Even after this Agreement is terminated, certain provisions will remain in effect.

8. Content Storage and Computer Software
The Company assumes no responsibility for the deletion of or failure to store your content, including profile details, photographs, or any other content. The Company will not be responsible for content that cannot be accessed due to Member not having necessary computer software, drivers, or codecs installed.

9. Member Privacy
The Company will not disclose to third parties the email address supplied by Members. Information will only be disclosed as necessary or appropriate to comply with applicable laws or in legal authorities where such information is relevant and has been requested with the appropriate authority.

The Company may suspend or terminate any Member who violates these Terms of Service. Members whose accounts are suspended for violation of the Terms Of Service are not eligible for a refund of their membership fees, if any, and are not allowed to create other profiles on this website.

10. Service Provision
This service is provided on an "as-is" basis by The Company without warranty of any kind, either expressed or implied, including, without limitation, warranties of title and the implied warranties of merchantability and fitness for a particular purpose.

11. Modifications to Terms and Conditions
The Company may modify these Terms Of Service from time to time in its sole discretion.

12. Legal Venue
This agreement will be governed by the laws of the State of Wisconsin of the United States of America, excluding that body of law known as conflicts of law and the United Nations Convention on Contracts for the Sale of Goods.

13. Validity
If any provision in these Terms Of Service is deemed to be invalid or unenforceable for any reason, the remaining provisions will continue in full force without being invalidated in any way.

14. Entire Agreement
This Agreement constitutes the entire agreement between the parties pertaining to the subject matter hereof, and supersedes in their entirety any and all written or oral agreements previously existing between the parties with respect to such subject matter.
